عبرت منظمة 'الخط الأمامي'- وهي منظمة حقوقية مقرها دبلن-ايرلندا- عن مخاوفها ألا يحصل الدكتور عبيد الوسمي المسجون منذ 11 ديسمبر الماضي بتهم ست سجلت ضده، وأضافت المنظمة على موقعها الالكرتوني أنها تخشى من ألا يحصل الوسمي على محاكمة عادلة حيث ذكرت أن القاضي الذي نظر قضية الوسمي هو نفس القاضي الذي نظر قضية المحامي والكاتب محمد الجاسم وهو وكيل وزارة مساعد بوزارة العدل-حسبما ذكرت المنظمة.
وأضافت المنظمة أنه لا مبرر قانوني لاستمرار سجن الوسمي ومعاملته بطريقة مهينة كالمجرمين بما لا يتوافق مع القوانين الكويتية. كما عبرت عن استيائها من عدم تحريك الدعاوى التي رفعها الدكتور الوسمي ضد من تعرضوا له بالضرب من قبل رجال قوات الأمن يوم 8 ديسمبر الماضي، حيث ذكرت أن الدكتور عبيد توجه للمخفر اليوم التالي لمقاضاة من اعتدى عليه بالضرب، ولكن دعواه لم ينظر فيها بعد، بينما تم اعتقاله يوم 11 ديسمبر بناء على تهم ست وجهت له. وقد ألحقت المنظمة بخبرها رابطا للاطلاع على كلمات عبيد الوسمي والضرب المبرح الذي تعرض له من قبل قوات الأمن.

Kuwait: Physical assault, arbitrary detention and fears of unfair trial against human rights defender Dr Obaid Alwasmi

On Monday 17 January 2011, human rights defender Dr Obaid Mohammed Al-Mutairi (known as Obaid Alwasmi), aged 39, will be brought for the second time before the Lower Criminal Court in Kuwait on six charges, all related to a speech he delivered in a public gathering on 8 December 2010.

Dr Obaid Alwasmi is a Professor of Law at the University of Kuwait and has published many articles and delivered many speeches on human rights issues in Kuwait including the independence of the Judiciary; corruption; freedom of assembly, and freedom of opinion, including in relation to the ongoing case of human rights defender and writer Mohammed Al-Jassem.
On 20 December 2010, Dr Obaid Alwasmi was officially charged in State Security Case No 7/2010. The charges relate to a speech delivered by Dr Obaid Alwasmi at a public seminar on 8 December 2010. Following the seminar the Security Special Force reportedly attacked those present at the gathering, dragged Dr Obaid Alwasmi from among the crowd, pulled him along the ground in a humiliating way, and beat him harshly.
A video of the event, which shows a part of the speech delivered by Dr Obaid Alwasmi and the subsequent attack, has been widely broadcast by satellite channels and on the internet. The video can be viewed at: http://www.reqaba.com/VideoDetails.aspx?id=225.
Dr Obaid Alwasmi was subsequently charged with:
1.Publicly undermining the instructions of the Head of State (theAmir) which forbid gatherings and political seminars in openplaces, in a seminar at Al-Harbash Villa (Diwania);
2.Instigating the Special Security Force not to carry out orders todisperse the gathering at the same seminar;
3.Broadcasting outside the country false and tendentious informationrelated to internal affairs of the country which could harm the image of the country and harm national interests through speaking at the seminar which was broadcast on satellite channels to the outside world, in which he accused the Prime Minister of misusing his authority in, among other things, suppressing freedoms and degrading citizens;
4.Participating in a gathering of more than 5 persons in a public place with intention to disturb public order, by gathering outside the aforementioned location and resisting security forces who attempted to disperse the gathering;
5.Not responding to the orders of Security Force officers to leave the aforementioned location;
6.Verbally assaulting public employees -- Security Force officers -- who had been instructed to maintain order.
At the first session of the trial, on 27 December 2010, some 180 lawyers volunteered to defend Dr Obaid Alwasmi. The judge asked to form a defense team of six lawyers only and adjourned the case to 17 January 2011.
On 9 December 2010, Dr Obaid Alwasmi had filed a complaint against the Ministry of Interior and the officers of the Security Special Forces who had assaulted him. On the evening of the same day, the Undersecretary at the Ministry of Interior filed a case against Dr Obaid Alwasmi; he was subsequently summonsed on 11 Dec 2010 and immediately detained.
Defence lawyers and representatives of human rights groups who have visited Dr Obaid Alwasmi in detention have stated that he is treated as a convict, being incarcerated alongside convicted prisoners, force to wear prisoners' clothes and forced to shave his hair, all in breach of Kuwaiti regulations relating to un-convicted detainees.
It is reported that no progress has been made regarding the complaint from Dr Obaid Alwasmi against the Ministry, while the case against Dr Obaid Alwasmi has led to his detention and charges against him.
Dr Obaid Alwasmi's continued detention constitutes a breach of Kuwaiti laws, which allow for the detention of an accused individual only if their release could compromise the investigation against them or lead to their escape.
Lawyers and human rights organisations have pointed out that these conditions are not met in Dr Obaid Alwasmi's case, as the investigation stage has already been passed and he could just as easily be prevented from travelling by a Court order while released on bail.
Concern is expressed that the articles relating to State security in Kuwaiti law which have been invoked against Dr Obaid Alwasmi, are vaguely phrased and could be easily used to incriminate and harshly punish persons for practicing basic rights and freedoms guaranteed by international human rights conventions.
Further concern is expressed in relation to the principle of independence of the judiciary in Kuwait, particularly in cases related to “State security” or involving senior officials or members of the ruling family. In this regard, it is alarming that the judge assigned to Dr Obaid Alwasmi's case is also acting as an executive official, the undersecretary at the Ministry of Justice. He is the same judge assigned for the state security case against human rights defender Mohammed Al-Jassem.
